Delta Flight 89 Fuel Dumping Settlement
This class action lawsuit, titled In Re: Delta Air Lines, Inc., arose from an incident on January 14, 2020, when Delta Air Lines Flight DL89 was forced to jettison jet fuel over parts of Southern California following an in-flight emergency shortly after departing Los Angeles International Airport (LAX).
Plaintiffs alleged that the fuel dump caused harm to property owners and residents in the affected area, claiming trespass, private nuisance, and related property damage. Delta denies wrongdoing and liability but agreed to settle the claims to avoid the cost and uncertainty of continued litigation.
Delta has agreed to pay a total of $78,750,000 into a Settlement Fund to resolve the class claims.
Who Is Included
You may be a Settlement Class Member if, on January 14, 2020, you owned, resided in, or rented one of the 1-to-4-unit residential properties listed on the map of affected residences below.
Payments from these funds will be distributed only to qualifying class members who submit valid Claim Forms. The amounts individual class members receive will vary and depend on the number of eligible claims and the final net fund amount.
